1. Agreement
These Terms of Service (“Terms”) govern your use of the TruScan Systems website, partner portal, and related services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
2. About TruScan Systems
TruScan Systems (Pty) Ltd is a South African company that provides custom AI-powered workflow automation services to businesses. Our services include but are not limited to: automation system design and development, partner and referral programme management, WhatsApp integration services, and ongoing system support and maintenance.
3. Services
Our services are provided on a custom, project-based basis. Pricing, scope, deliverables, and timelines are agreed upon in writing before any project commences. Each project is governed by a separate service agreement or statement of work.
4. Partner Programme
The TruScan Partner Programme is a referral and rewards system governed by the following terms:
Eligibility
Partners must be 18 years or older and must be approved by TruScan before participating in the programme. TruScan reserves the right to approve or reject partner applications at its discretion.
Points and Tiers
Partners earn points for qualifying activities as defined in the programme. Points convert to rands at a rate determined by the partner's tier level. TruScan reserves the right to modify point values, tier thresholds, and conversion rates with reasonable notice.
Redemption
The minimum redemption amount is R500. Redemptions are processed via EFT to a South African bank account provided by the partner. Processing times may vary but typically take 5–10 business days after approval.
Fraud Prevention
TruScan employs fraud detection measures including device fingerprinting, geographic verification, and scan-to-action ratio monitoring. Any activity deemed fraudulent may result in forfeiture of points and suspension or termination of the partner account without prior notice.
5. Acceptable Use
You agree not to: use our services for any unlawful purpose; attempt to manipulate or defraud the partner programme; interfere with the operation of our platform; impersonate another person or entity; attempt to gain unauthorised access to our systems; or use automated tools to generate fraudulent scans or referrals.
6. Intellectual Property
All content, software, designs, and systems created by TruScan remain the intellectual property of TruScan Systems (Pty) Ltd unless explicitly transferred in a written agreement. Client-specific automation systems are licensed to the client under the terms of their service agreement.
7. Limitation of Liability
To the maximum extent permitted by South African law, TruScan Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our services. Our total liability shall not exceed the amounts paid by you to TruScan in the 12 months preceding the claim.
8. Privacy
Your privacy is important to us. Please refer to our Privacy Policy and POPIA Compliance page for details on how we collect, use, and protect your personal information.
9. Termination
TruScan may suspend or terminate your access to our services at any time for violation of these Terms. Partners may request account closure at any time by contacting our Information Officer. Upon termination, any unredeemed points below the minimum redemption threshold will be forfeited.
10. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the revised Terms.
